Comments made by Parents to a Survey Regarding the Proposed Special Education Regulations,
Submitted April 4, 2006

SECTION 3: INDIVIDUAL EDUCATIONAL PROGRAMS (IEP)

Changes in the IEP

Under the prior law, changes to an IEP after the annual review were only made at an IEP team meeting. The IEP document was revised to reflect the changes made by the team and all members of the team, including parents, received a copy of the revised IEP.

Under the new IDEA, changes to the IEP can also be made without a meeting and documentation of the change can be reflected in an amendment attached to the original IEP. Federal law states that parents can obtain a copy of the amended IEP “upon request”.

Do you support Vermont’s proposed special education regulation that requires schools to provide parents with a copy of the amended IEP automatically, rather than upon request?

This should be happening already without this question being asked. The parent shouldn't have to fight the school to get copies of things and believe me, this does happen.

copy and rationale for the change written in language easily understood by the parent.

I was in this situation and was involved in the meeting to amend my daughters I.E.P.I received a copy but it was not upon request. I think it is a parents right to receive a copy just as it is their right to get parental rights.

Absolutely, parents need to be aware of any and all changes made to the IEP - parents need to be part of any decisions to make changes in the IEP!

And, what kind of changes can be made and approved by whom?

The parent should also be giving consent for the change other wise a change could be made without their knowledge

Short-term objectives don’t just help the PARENT assess the child's progress. They help the EDUCATORS assess the child's progress AND whether or not they are effectively teaching that child AND whether or not a specific type of intervention is effective!!!

Parents need information. Families can only hold schools accountable if they know about changes.

Definitely, parents should be automatically notified of any important changes

Again, changes would be made that may negatively impact a child if they were NOT REQUIRED to notify parents. I also feel that there should be a phone call required. People can say they mailed it and NOT mail it. It is important that there be contact. I'm sorry if I'm not sounding trusting, but I have heard the stories.

YES! YES! YES! Absolutely imperative that this must be done!

Parents should receive a copy of an amended iep automatically

There should be a process if the family chooses to decline a copy of the IEP. There should also be a defined process to decline a copy of parental rights if family chooses.

How would parents know if changes were made otherwise?

It should be automatic, with a timeline. The potential arises that parents may make a statement that the school interprets as permission to change an IEP. Receiving the new amended IEP within a specific timeframe gives the parent the knowledge that there has been a change to an IEP and/or FAPE.
